The contact stated the failure was due to throttle delay failed to respond. The vehicle was previously repaired under NHTSA campaign number: 19V757000 (engine and engine cooling) at nyle maxwell Chrysler Dodge Jeep Ram of austin (13401 highway, ranch rd 620 N, austin, tx 78717 (512) 518-1097). The manufacturer was contacted but no further assistance was provided. The failure mileage was 38,000. Consumer stated V08 was done in January and could not qualify to install VA7 update that restored the engine performance. The consumer stated his truck was part of a settlement Ram ecodiesel class-action and was awarded $3000 under the V08 recall whereas he chose not to have it done until parts are available under nthsa VB1. The consumer wanted VA7 update restoring the engine but fca is stating the consumer doesn't qualify because of the fact V08 done after January.
