THE TAILGATE BECOMES INOPERABLE.

Brought the car to the dealer. They reset system and the problem came back a few days later. The second reset was at ~9500 miles and it's still OK, but I'm not sure for how long.

Do I have a way to use lemon law?

Rear rear hatch does not always open. You will hear three beeps and the hatch will not open no matter what you do as far as the switch or the button in the car corrects the problem. The only remedy that I found was that I would have to disconnect the battery cable, wait a minute, reconnect it then it would work. My car is a 2019 and this problem has happened multiple times. Took it to the dealer, and they could not replicate the problem.

Rear Tail gate would not open. I only had my brand new 2019 Subaru Forester for 2 days when the rear tail gate would not open. I called the dealer, and they suggested removing the battery cable to "reset" the system. I did not want to remove the factory seal from the battery posts, so I searched the manual (which is hard to follow) and found "Initialization of rear gate" in the Rear gate section of the manual. (page 148 in my manual). #1. Keep pressing the rear gate opener button until it is unlocked and lift up the rear gate..... etc.

I have had to do this several times in the past 1 1/2 years, but it sure beats the screw driver or battery post options!!

A tailgate not opening is annoying especially when the vehicle is only months old. The fact that the only way to open it is to have a screwdriver with you (and who has that) and climb through the back seat to the compartment that has the manual release for the tailgate. The fact that it wasn't correctly diagnosed the first time is also annoying. The fact that my Subaru dealership takes appointments like mine 11:00 AM, but doesn't even look at my vehicle until 4 PM and that was after several calls. In the end a repair was made and hopefully the problem is finally solved.

I tried opening my tailgate yesterday with the button on the instrument panel to the left of the steering wheel. 3 or 5 beeps and nothing. So I tried the key fob-same deal. Lastly I pushed the button on the trunk handle and same result. Not sure if it has anything to do with the heat and/or humidity we've been having in Chicago lately but this sucks. I'm planning a camping excursion soon and if this happens when I arrive at my destination, there's gonna be hell to pay.
