Consumer was traveling approximately 45 mph on I-75, there was construction on the side and traffic was stopped over a hill, consumer did not see stopped traffic and rearended a vehicle, upon impact the driver and passenger airbags did not deploy, the seatbelts failed causing the driver and passenger to hit the windshield.
Design flaw of the passenger side rear shoulder belt operated erraticly trapping the child in the seat with the belt portion wrapped around the child neck. However, the belt was removed by cutting the belt off from around child's neck. Dealer replaced the shoulder belt.
