The consumers vehicle was stopped when another vehicle which was driving about 45 mph rear ended the consumer. The driver and passenger seat backs collapsed and as a result the consumer sustained an injured back.
While stopped in traffic, the car was hit from behind by another vehicle. Upon impact, the driver's side front seat-back broke, causing the driver and seat-back to fall backward into the lap and chest of the rear seat passenger, and rendering the driver unable to control the vehicle. State farm insurance was informed of the seat back failure - state farm claim representative stated that seat back failure is a designed safety feature. I do not believe that seat back failure is a safety feature, and I would like your position on this issue.
