Consumer has two Ford Mustangs, 1998 affected by recall 00V349000. Vehicle identification numbers are: [xxx] and [xxx]. local dealership is unable to order the parts from manufacturer to correct the defect until December of 2001. Recall component failed prior to recall (00S37) notification resulting in collision, the vehicle was parked with the emergency brake engaged when it failed, the vehicle rolled into the lawn, knocking down a pine tree. (insurance company writing in)
When vehicle was parked on a declining slope, the emergency break slipped and vehicle starting rolling, vehicle taken to dealership, dealer found no prolbem, however, 9 months later owner received recall (00V-349), problem has been corrected.
Consumer stopped vehicle on a slight grade, applied emergency brake, and exited vehicle, a pop sound was heard and vehicle began to roll down the grade until it struck a tree, consumer is requesting payment for damages be made to insurance company. (a recovery management specialist wrote in for client)
