Driving appx 30 MPH. Car pulled out in front of me. I had to choose between T-boning it, or swerve into oncoming traffic. Opted for T-bone, but was thrown into oncoming. Impacted two cars, and ended up with a head-on impact also. My van was a total loss. This was a 2004 Freestar Limited Van. Perfect condition. 154000 miles. Second owner.
Though van was equipped with front, side, and second and third row airbags, NOT ONE OF THEM DEPLOYED. Van was towed to a local body shop, where it was declared a total loss. Photos taken by adjuster shows the interior and verifies there were NO AIRBAGS that deployed. Additionally, besides the photos, the body shop, the adjuster and claim agent can verify this.
I was the driver and had my seat belts buckled. Injuries are extensive. No blood or cuts, but damaged C-T- & L-spine. Fractured my sternum, plus head, neck and leg injuries. I have continued pain, multiple medical visits, pain meds, physical therapy, and chiropractor's appointments.This will be my life from now on. PIP was exhausted shortly after the E.R. visits and original medical visits. At fault driver carried only the minimum required by Kentucky of $25.000.
I am now faced with tens of thousands in Medical bills, and will continue to need physical therapy and adjustments to my spinal column as well as continued therapy for my neck, chest, and shoulder pain.
Does anyone know if there is anything I can do about the defective or problematic air bags in these vans? Do I have a chance to recover any of my additional medical expenses and the ongoing pain for the rest of my life? Are there any lawsuits being filed against Ford Motor Company about these horrible airbags?
Not sure where to go with this, or if there is anything else I can do? Bert33
