We took our 2009 Ford Escape in for inspection, and it failed due to a rusted-out engine cradle, sub frame. After looking into it, Ford recalled earlier model year Escapes for the same reason. Unfortunately, the 2009 Escape was not included in the recall. Same problem but not covered. I was told the subframes were not treated with rust preventative, and that is how it appears on the 2009. The subframe is almost completely rusted, and parts attached to it have the factory paint still on them. This makes me think they neglected the proper finish on the subframe.
