On September 22 while backing out of our garage my wife found that our brand new BMW X-5 would not respond to brake application, would not slow down, would not shift out of reverse into neutral or drive, could not engage the parking brake, nor turn off when the on-off button was engaged. It continued to travel in reverse until the vehicle collided with a chain link fence which caused considerable damage to the rear of the vehicle as well, as severely damaging the fence and multiple metal fence posts at which time the vehicle lurched to a stop.

BMW, of course, claims that they can find nothing wrong with the vehicle to have caused such an event, nor can they explain how one would go about stopping the vehicle if and when the vehicle were to do a similar event, either in reverse or in drive. They expect us to simply repair the vehicle, continue making payments and act as if nothing had ever happened, while we are simply afraid to drive it for fear of a re-occurrence without any way to avoid another collision, perhaps the second time with even fatal results.
