The waste gate on my 2010 A4 Turbo failed with less than 50K miles. Dealership said they would not cover the repair (known issue) "because the car had California emissions it did not qualify". They also said based on the error code that it was not the waste gate. When I finally replaced the turbo I was able to confirm that it was the waste gate that failed. At the time I also spoke with the Audi Loyalty Team to get them to help me convince the dealership to cover the repair. Per their request I sent in all service/maintenance receipts and the dealership did not offer any help with paying for the repair.
