On October 15, 2024 while parking my 2024 Alfa Romeo Tonale I experienced “unintended acceleration while braking”. I pressed the brake, and the vehicle accelerated instead of braking causing me to crash. I opened a claim with Alfa Romeo and was contacted by Bosch Automotive Service Solutions. I was asked to sign a consent form so they could download the EDR (Event Data Recorder) and inspect the vehicle. I specifically asked and was told by James Brozovich (BOSCH) that I would get copies of all data/reports. Alfa Romeo determined the accident was “not due to a manufacturing responsibility”. But no information was ever sent to me. The responses I received from Stellantis (Alfa Romeo) appear to have been AI generated, since they did not address the incident, contain any information, or were even addressed to me. My insurance company paid to fix the body damage, but NOT whatever defect caused the accident. I am driving around in a vehicle that could malfunction again and potentially injure or kill someone.
According to 49 CFR 563 (Code of Federal Regulation) the EDR (blackbox) and all its data belong to me. Stellantis refusing to provide me copies of the information to avoid responsibility may be a violation of Florida Statue Title XLVI Chapter 815.06 Computer Related Crimes Section 3.b.2 (Commits the offense for the purpose of devising or executing any scheme or artifice to defraud or obtain property. I demand Stellantis provide me copies of all data/reports and information relating to my vehicle and their “investigation”.
